Service Availability

Gymhire.ie services are only intended for use by people resident in Ireland (“Serviced Countries”). We do not accept orders from individuals outside this country.

By placing an order through our website, you warrant that you are legally capable of entering into binding contracts, you are at least 18 years old; you are resident in one of the Serviced Countries, and you are accessing our site from that country.

Changes To The Website

We reserve the right to make changes to these Terms from time to time. All changes will take effect as soon as they are posted on the website and will apply to all contracts for the purchase of products from that date. It is your responsibility as a visitor to the website to read the terms and conditions every time you use this website.
Any waiver of these the terms and conditions can only be effective when written and signed by our authorised representative. In this case, the other provisions of these Terms remain fully remain intact.

Confirmation of Customer Orders

After placing an order, the customer will receive an email from us acknowledging that Gymhire.ie has received your order. Please note that this does not mean that orders have been accepted. The order constitutes a request of Gymhire.ie to hire a product for the period specified in the email.

All orders are subject to acceptance by Gymhire.ie, and confirmation of such acceptance will be made via email confirming that the product has been dispatched (“Dispatch Confirmation”). The contract between the customer and Gymhire.ie (“Contract”) will only be formed when products are dispatched. Until that time, the customer may be notified that the order was not accepted, or the customer may cancel it.

All products ordered through the website will remain the property of Gymhire.ie.

Payment

Gymhire.ie commits to processing orders as soon as payment is received. Once customer payment details have been verified and stock availability is confirmed, the item is ready to be shipped for delivery.

To ensure that customer payment details are not used without permission, Gymhire.ie will validate information given during the order process (name, address and other personal information submitted by the customer) against appropriate third party databases.

By agreeing to these Terms, customers of Gymhire.ie agree to these checks. This information is only used to check identity. No credit checks are performed and this will not affect customer credit ratings. All information provided by the customer will be treated in accordance with the Data Protection Act 1998.

Gymhire.ie employs a third party merchant service provider that is compliant in respect of the payment card industry data security standards (PCI DSS version 2).

Delivery

Gymhire.ie makes every effort to meet the delivery dates referenced in customer orders. However, occasionally due to unforeseen factors, delays are inevitable. Gymhire.ie shall not be held responsible for any delay or failure to deliver products within the estimated timescales if it is wholly or partly caused by circumstances which do not lie within our control.

If no one is available at the provided shipping address to accept the order, a note will be left to advise of the current location of the order, which could be with a neighbouring address. Alternatively, orders may have been returned to one of the carrier’s depots, and the note will advise on how to take delivery of the order.

The risk of damage or loss of products remains the responsibility of Gymhire.ie until the earlier of the date the product passes to customer (having paid in full for the product) or the date the first delivery attempt was made.

Delivery refunds can only be made in accordance with consumer legal rights under the Consumer Protection Distance Selling Regulations 200 or other applicable legislation.

Accuracy of Content

Except as set out below, the price paid is the price that was displayed at the time an received your order, except in the case of error.

While Gymhire.ie endeavours to ensure all prices on the website are accurate, errors sometimes are inevitable. If an error in price is identified, the customer will be contacted as soon as possible to offer the options of reconfirming with the actual price or the cancellation of the order.

If Gymhire.ie is unable to contact the customer, the order will automatically be cancelled. If cancelled by the customer but payment has already been process, the customer will be refunded in full.

All prices are shown in Euro. All sizes, measurements and dimensions are approximate. Gymhire.ie endeavours to display all dimensions as accurately as possible, yet 100% accuracy cannot be guaranteed in all cases.

Additionally, Gymhire.ie will make every effort to use product images that represent the actual product available in the Gymhire.ie Shop.

Returns

Under the Consumer Protection Distance Selling regulations, customers retain the right to cancel orders within 24 hours, beginning on the day products are received. In this case, a full refund of the price paid for the products will be made to the customer, which will be processed in accordance the Refunds section below and otherwise in accordance with consumer statutory rights. 

If the customer wishes to cancel your order, Gymhire.ie must be informed in writing by e-mail. The item must be returned to Gymhire.ie in the original packaging and in the same condition in which it was received by the customer.

These Terms do not affect other statutory rights as a consumer are not intended to be a full statement of consumer statutory rights. For more information on consumer rights under protection of the distance selling regulations, please contact the customer’s local authority, trading standards department or a consumer advice centre.

On rare occasions, it is possible that product specifications change. If this is the case, Gymhire.ie will contact customers as soon as possible to offer an alternative product similar to the original product. If the customer is not satisfied with the substitute or replacement, please contact the Gymhire.ie customer service team at sales@gymhire.ie.

Gymhire.ie will arrange a collection of items in their original packaging and make provisions for a full refund to the customer in accordance with the refunds policy in the Refunds section below.

If the customer believes the product received to be defective, damaged or incorrect, Gymhire.ie must be informed within a reasonable amount of time. Please do not return the product to Gymhire.ie in the first instance. Rather, a member of the Gymhire.ie team will contact the customer to discuss an appropriate remedy, including, without limitation, a repair or replacement parts, a replacement product or a full refund.

Where a refund is proposed and accepted, the full value of that product will be refunded to the customer, in addition to any applicable delivery charges and any reasonable incurred by the customer.

Refunds

If an order is cancelled in accordance with the Returns section above, Gymhire.ie will refund any money paid by the customer after the ordered products have been returned to Gymhire.ie. The refund will be made to the card account used in the original transaction and, as mentioned above, is subject to the regulations set for goods damaged on return or for which Gymhire.ie arranged the collection.

Legal Guarantee

Gymhire.ie warrants that any product purchased for hire from through the Gymhire.ie online Shop is in conformity with the product specification and description on the website, are fit for the purposes for which products of the same type are normally used and show the quality and performance which are normal in products of the same type and which can be reasonably expected. This legal guarantee also covers damage which may occur during shipping.

In case of a lack of conformity, customers are entitled to have the products brought into conformity free of charge by repair or replacement or, if this is impossible or disproportionate, to an appropriate reduction in the price or a refund. If the product is damaged, please do not hesitate to contact the Gymhire.ie customer service team at sales@gymhire.ie.

This legal guarantee does not affect or interfere with any of other rights as a customer based on national laws and regulations.
Consumer rights under the legal guarantee become invalid if any party other than the manufacturer or any repair service not designated by Gymhire.ie modifies the product.

GDPR regulation

Gymhire.ie is committed to delivering exceptional service in the utmost professional manner. To ensure compliance with General Data Protection Regulation (GDPR), effective as of 25th May 2018, Gymhire.ie declares that following customer information is retained by Gymhire.ie

This information is used by Gymhire.ie to allow us to process customer orders, for general correspondence and to notify customers of company related news, information on promotions and product related information such stock levels.

If an order is placed with Gymhire.ie, customer delivery information must be shared with chosen couriers in order to ensure delivery. Gymhire.ie will never sell any retained customer data. Gymhire.ie will never share retained customer data without prior customer consent. No sensitive information such as credit card details are held by Gymhire.ie. All customer data is held securely.
